1. Agreement and eligibility
By creating an account, using the marketplace or accepting a booking, you agree to these Terms and the Privacy Policy. If you use the service in Thailand, you must be at least 20. Elsewhere, you must be at least 18 and have reached the legal age required to enter this agreement. You must provide accurate information and protect your account credentials.
2. Marketplace role
TripBidTravel, also presented under the RoamBid product name, operates a technology marketplace. Travelers publish requests and independent suppliers submit private offers. Unless expressly stated at checkout, TripBidTravel is not the tour, transport, boat, guide or activity operator and does not control how an independent supplier performs the service.
3. Supplier requirements and insurance
Suppliers must be legally permitted to provide every offered service and maintain all required identity documents, business and tourism licences, driver or guide licences, vehicle or boat registrations, permits and adequate, valid insurance appropriate to the service, activity, vehicle, vessel, personnel and passenger capacity. Suppliers are solely responsible for understanding their legal and insurance obligations, ensuring that coverage remains effective for each booking, and accurately describing material limitations or exclusions. Documents must be current and genuine. Approval or a verification badge is a limited platform check, not a guarantee of legality, safety, quality, insurance validity, scope of coverage or claim payment. TripBidTravel may request renewed evidence at any time.
4. Requests, private offers and booking formation
Travelers must provide correct dates, Thailand start time, party size, pickup needs and material requirements. Suppliers must state the complete price, inclusions, exclusions, schedule and relevant restrictions. Competing suppliers cannot see one another’s prices. A booking is formed only after an offer is accepted and every required reservation or payment step shown at confirmation is completed.
5. Prices, platform fees and payment
All fees, currencies and payment methods must be shown before confirmation. The planned traveler platform fee is 3% unless a different amount is displayed before booking. The tour price may be paid through the platform or directly to the supplier according to the checkout shown. Cash does not remove any disclosed platform fee. A licensed payment provider will collect, hold and route card or bank funds under its own terms. TripBidTravel does not itself hold customer stored value and must not store complete card numbers or security codes. Users must not move a platform introduction off-platform to avoid fees.
6. Traveler cancellation and no-show
A traveler may cancel without a TripBidTravel cancellation charge at least 24 hours before the stated Thailand start time. A cancellation made less than 24 hours before start, or a traveler no-show, is charged the full tour price, except where mandatory consumer or controlled-contract law requires a different cancellation period, charge or refund, or a more favorable booking-specific policy is displayed at confirmation. Payment-provider charges and legally required refunds remain applicable.
7. Supplier cancellation and replacement
A supplier cannot simply cancel an accepted booking. The supplier may request a replacement, but remains responsible for performance until another approved supplier accepts the same service at no greater price and the replacement is confirmed through TripBidTravel. If no replacement is confirmed, the original supplier must perform the booking. Emergency and force-majeure situations will be assessed individually, and TripBidTravel may refund the traveler, arrange alternatives, suspend the supplier or recover reasonable resulting costs where legally permitted.
8. Safety, insurance checks and personal responsibility
Users must not engage in fraud, unsafe conduct, harassment, discrimination, illegal activity, fake documentation, price manipulation or misleading statements. Suppliers are responsible for trained personnel, safe and properly maintained equipment, lawful passenger capacity, emergency procedures and legally adequate insurance. Before accepting an offer, travelers are responsible for assessing whether the service is suitable for them and for asking the supplier to confirm current licences and insurance, including coverage, exclusions and passenger limits. Travelers should obtain their own travel, medical, accident and activity insurance where appropriate, follow safety instructions and disclose relevant accessibility or medical needs. A platform badge or document review does not replace these checks. Immediate danger should be reported to local emergency services first.
9. Messages and personal information
Booking communications should remain in the platform so that arrangements and disputes can be reviewed. Contact information is shared only when needed for a request or accepted booking. Users may not scrape, sell, misuse or contact another user for unrelated marketing.
10. Reports, reviews and enforcement
Travelers may report no-shows, unsafe service, misconduct, fraud or other booking problems. TripBidTravel may review messages and booking records, request evidence, reject documents, remove content, limit features, suspend or permanently block accounts. Reviews may be submitted only by the traveler after a non-cancelled booking’s scheduled start and must describe a genuine experience without threats, incentives or manipulation.
11. Refunds, disputes and chargebacks
Users should report a booking problem promptly and provide relevant evidence. Refunds and payment disputes depend on the booking record, cancellation timing, supplier performance, payment-provider rules and mandatory law. Starting a chargeback does not automatically decide the underlying dispute.
12. Availability, insurance and liability
The service may be changed, interrupted or unavailable. TripBidTravel is not an insurer, insurance broker, tour operator or guarantor of a supplier’s coverage. Each supplier remains responsible for its service, legal compliance and insurance, and each traveler remains responsible for reviewing the offer, asking appropriate safety and insurance questions, deciding whether to participate and arranging personal insurance. Nothing excludes liability that cannot legally be excluded. To the maximum extent permitted by law, TripBidTravel is not responsible for indirect loss or for an independent supplier’s acts, omissions, transport, equipment, safety, licensing, insurance or performance. Travelers retain all non-waivable consumer rights.
13. User content and platform rights
Users retain ownership of content they submit. They grant TripBidTravel a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format and moderate that content only as reasonably needed to operate, secure and promote the marketplace and the relevant listing or booking. Users confirm that they have the rights needed to submit the content. TripBidTravel’s name, software, design and other platform materials remain protected and may not be copied or misused.
14. Indemnity
To the extent permitted by law, a supplier will defend and indemnify TripBidTravel and its operator against third-party claims, losses and reasonable costs arising from that supplier’s service, negligence, unlawful or unlicensed activity, inadequate insurance, content or breach of these Terms. Every user is similarly responsible for third-party claims caused by their fraud, illegal conduct, content or deliberate misuse of the platform. This clause does not apply to the extent a claim was caused by TripBidTravel’s own unlawful conduct and does not limit non-waivable rights.
15. Platform interruptions and force majeure
TripBidTravel is not responsible for delay or failure caused by events reasonably beyond its control, including natural disasters, severe weather, public emergencies, government action, transport disruption, internet or cloud outages, cyberattacks or payment-network failure. This does not remove any refund or consumer right that cannot legally be excluded.
16. Language
English and Thai versions are intended to communicate the same rules. If mandatory law requires the Thai version to control, the Thai version controls. Otherwise, if an inconsistency remains after reasonable interpretation, the English version controls. Users should contact TripBidTravel before accepting if they do not understand either version.
17. General legal terms
If any provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. Users may not assign their account or agreement without written consent. TripBidTravel may assign this agreement as part of an incorporation, reorganization, financing or sale, subject to applicable law and notice where required. These Terms, the Privacy Policy and booking-specific terms form the entire agreement about use of the marketplace. Electronic notices may be sent to the account email or displayed in the service.
18. Changes, governing rules and contact
Material changes may require renewed acceptance. Mandatory laws and consumer protections of the traveler’s country and the place of service continue to apply. The operator’s legal identity, registered address, governing-law and dispute-venue clause, invoice details and licensed payment-provider details will be finalized and displayed before paid transactions are activated. 2. บทบาทของตลาด
TripBidTravel ซึ่งแสดงภายใต้ชื่อผลิตภัณฑ์ RoamBid ด้วย เป็นผู้ให้บริการตลาดเทคโนโลยี นักท่องเที่ยวเผยแพร่คำขอและผู้ให้บริการอิสระส่งข้อเสนอส่วนตัว เว้นแต่ระบุชัดเจนตอนชำระเงิน TripBidTravel ไม่ใช่ผู้ดำเนินการทัวร์ รถ เรือ ไกด์ หรือกิจกรรม และไม่ได้ควบคุมการปฏิบัติงานของผู้ให้บริการอิสระ
3. ข้อกำหนดสำหรับผู้ให้บริการและประกัน
ผู้ให้บริการต้องมีสิทธิตามกฎหมายในการให้บริการ และต้องมีเอกสารประจำตัว ทะเบียนธุรกิจ ใบอนุญาตท่องเที่ยว ใบขับขี่หรือใบอนุญาตไกด์ ทะเบียนรถหรือเรือ ใบอนุญาต และประกันที่เพียงพอและมีผลใช้บังคับซึ่งเหมาะกับบริการ กิจกรรม ยานพาหนะ เรือ บุคลากร และจำนวนผู้โดยสาร ผู้ให้บริการมีหน้าที่แต่เพียงผู้เดียวในการเข้าใจข้อผูกพันทางกฎหมายและประกัน รักษาความคุ้มครองของทุกการจอง และเปิดเผยข้อจำกัดหรือข้อยกเว้นที่สำคัญ เอกสารต้องเป็นของจริงและไม่หมดอายุ เครื่องหมายยืนยันเป็นเพียงการตรวจสอบอย่างจำกัดของแพลตฟอร์ม ไม่ใช่การรับประกันความถูกต้องตามกฎหมาย ความปลอดภัย คุณภาพ ความมีผลหรือขอบเขตของประกัน หรือการจ่ายค่าสินไหม
4. คำขอ ข้อเสนอส่วนตัว และการจอง
นักท่องเที่ยวต้องแจ้งวันที่ เวลาเริ่มตามเวลาประเทศไทย จำนวนคน จุดรับ และข้อกำหนดสำคัญอย่างถูกต้อง ผู้ให้บริการต้องแจ้งราคารวม สิ่งที่รวมและไม่รวม กำหนดการ และข้อจำกัด คู่แข่งจะไม่เห็นราคาของกันและกัน การจองเกิดขึ้นเมื่อยอมรับข้อเสนอและดำเนินขั้นตอนสำรองหรือชำระเงินที่แสดงครบถ้วน
5. ราคา ค่าธรรมเนียม และการชำระเงิน
ค่าธรรมเนียม สกุลเงิน และวิธีชำระเงินต้องแสดงก่อนยืนยัน ค่าธรรมเนียมนักท่องเที่ยวที่วางแผนไว้คือ 3% เว้นแต่จะแสดงจำนวนอื่นก่อนจอง ราคาทัวร์อาจชำระผ่านแพลตฟอร์มหรือโดยตรงแก่ผู้ให้บริการตามหน้าชำระเงิน การจ่ายเงินสดไม่ยกเลิกค่าธรรมเนียมแพลตฟอร์ม ผู้ให้บริการชำระเงินที่ได้รับอนุญาตจะเป็นผู้รับ ถือ และส่งต่อเงินตามข้อกำหนดของตน TripBidTravel ไม่ถือเงินคงเหลือของลูกค้าเองและไม่เก็บหมายเลขบัตรเต็มหรือรหัสความปลอดภัย
6. การยกเลิกโดยนักท่องเที่ยวและการไม่มา
นักท่องเที่ยวยกเลิกได้โดยไม่มีค่าธรรมเนียมการยกเลิกของ TripBidTravel หากยกเลิกอย่างน้อย 24 ชั่วโมงก่อนเวลาเริ่มตามเวลาประเทศไทย หากยกเลิกช้ากว่านั้นหรือไม่มา จะคิดเต็มราคาทัวร์ เว้นแต่กฎหมายคุ้มครองผู้บริโภคหรือกฎหมายสัญญาควบคุมกำหนดระยะเวลา ค่าธรรมเนียม หรือเงินคืนที่แตกต่าง หรือมีนโยบายเฉพาะการจองที่เป็นประโยชน์กว่าซึ่งแสดงตอนยืนยัน
7. การยกเลิกโดยผู้ให้บริการและผู้ให้บริการทดแทน
ผู้ให้บริการไม่สามารถยกเลิกการจองที่ยอมรับแล้วได้ทันที ผู้ให้บริการอาจขอผู้ให้บริการทดแทน แต่ยังรับผิดชอบจนกว่าผู้ให้บริการที่ได้รับอนุมัติรายอื่นจะรับบริการเดียวกันในราคาไม่สูงกว่าและได้รับการยืนยันผ่าน TripBidTravel หากไม่มีผู้รับแทน ผู้ให้บริการเดิมต้องให้บริการ เหตุฉุกเฉินและเหตุสุดวิสัยจะพิจารณาเป็นรายกรณี
8. ความปลอดภัย การตรวจสอบประกัน และความรับผิดชอบส่วนบุคคล
ห้ามฉ้อโกง ให้บริการไม่ปลอดภัย คุกคาม เลือกปฏิบัติ ทำกิจกรรมผิดกฎหมาย ใช้เอกสารปลอม บิดเบือนราคา หรือให้ข้อมูลทำให้เข้าใจผิด ผู้ให้บริการรับผิดชอบบุคลากร อุปกรณ์ จำนวนผู้โดยสาร ขั้นตอนฉุกเฉิน และประกันที่กฎหมายกำหนด ก่อนยอมรับข้อเสนอ นักท่องเที่ยวรับผิดชอบในการพิจารณาว่าบริการเหมาะสมหรือไม่ และขอให้ผู้ให้บริการยืนยันใบอนุญาตและประกันปัจจุบัน รวมถึงความคุ้มครอง ข้อยกเว้น และจำนวนผู้โดยสาร นักท่องเที่ยวควรจัดทำประกันการเดินทาง การแพทย์ อุบัติเหตุ และกิจกรรมของตนเองตามความเหมาะสม ปฏิบัติตามคำแนะนำด้านความปลอดภัย และแจ้งความต้องการด้านการเข้าถึงหรือสุขภาพ เครื่องหมายยืนยันหรือการตรวจเอกสารของแพลตฟอร์มไม่แทนที่การตรวจสอบเหล่านี้
9. ข้อความและข้อมูลส่วนบุคคล
ควรเก็บการสื่อสารเกี่ยวกับการจองไว้ในแพลตฟอร์มเพื่อใช้ตรวจสอบการจัดเตรียมและข้อพิพาท ข้อมูลติดต่อจะแชร์เมื่อจำเป็นสำหรับคำขอหรือการจองที่ยอมรับแล้ว ห้ามรวบรวม ขาย ใช้ข้อมูลผิดวัตถุประสงค์ หรือติดต่อเพื่อการตลาดที่ไม่เกี่ยวข้อง
10. รายงาน รีวิว และการบังคับใช้
นักท่องเที่ยวสามารถรายงานการไม่มา บริการไม่ปลอดภัย การประพฤติมิชอบ การฉ้อโกง หรือปัญหาอื่น TripBidTravel อาจตรวจข้อความและข้อมูลการจอง ขอหลักฐาน ปฏิเสธเอกสาร ลบเนื้อหา จำกัดฟังก์ชัน ระงับ หรือบล็อกบัญชีถาวร รีวิวส่งได้โดยนักท่องเที่ยวหลังเวลาเริ่มของการจองที่ไม่ถูกยกเลิกเท่านั้น และต้องเป็นประสบการณ์จริง
11. การคืนเงิน ข้อพิพาท และการปฏิเสธรายการ
ควรรายงานปัญหาการจองโดยเร็วและส่งหลักฐานที่เกี่ยวข้อง การคืนเงินและข้อพิพาทขึ้นอยู่กับข้อมูลการจอง เวลายกเลิก การให้บริการ กฎของผู้ให้บริการชำระเงิน และกฎหมายที่บังคับใช้
12. ความพร้อมใช้งาน ประกัน และความรับผิด
บริการอาจเปลี่ยนแปลง หยุดชะงัก หรือไม่พร้อมใช้งาน TripBidTravel ไม่ใช่ผู้รับประกัน นายหน้าประกัน ผู้ดำเนินการทัวร์ หรือผู้ค้ำประกันความคุ้มครองของผู้ให้บริการ ผู้ให้บริการแต่ละรายยังคงรับผิดชอบบริการ การปฏิบัติตามกฎหมาย และประกันของตน ส่วนนักท่องเที่ยวยังคงรับผิดชอบการตรวจข้อเสนอ การถามเรื่องความปลอดภัยและประกัน การตัดสินใจเข้าร่วม และการจัดทำประกันส่วนบุคคล ไม่มีข้อความใดยกเว้นความรับผิดที่กฎหมายห้ามยกเว้น ภายในขอบเขตที่กฎหมายอนุญาต TripBidTravel ไม่รับผิดชอบความเสียหายทางอ้อมหรือการกระทำ การละเว้น การขนส่ง อุปกรณ์ ความปลอดภัย ใบอนุญาต ประกัน หรือการให้บริการของผู้ให้บริการอิสระ
13. เนื้อหาของผู้ใช้และสิทธิของแพลตฟอร์ม
ผู้ใช้ยังคงเป็นเจ้าของเนื้อหาที่ส่ง และให้สิทธิแบบไม่ผูกขาด ทั่วโลก และไม่เสียค่าลิขสิทธิ์แก่ TripBidTravel ในการจัดเก็บ ทำซ้ำ แสดง จัดรูปแบบ และตรวจสอบเนื้อหาเท่าที่จำเป็นต่อการดำเนินงาน ความปลอดภัย และการประชาสัมพันธ์ตลาดหรือการจองที่เกี่ยวข้อง ผู้ใช้ยืนยันว่ามีสิทธิส่งเนื้อหานั้น ชื่อ ซอฟต์แวร์ การออกแบบ และทรัพย์สินของแพลตฟอร์มยังได้รับความคุ้มครอง
14. การชดใช้ความเสียหาย
ภายในขอบเขตที่กฎหมายอนุญาต ผู้ให้บริการต้องปกป้องและชดใช้ TripBidTravel และผู้ดำเนินการจากการเรียกร้องของบุคคลภายนอก ความเสียหาย และค่าใช้จ่ายอันสมควรที่เกิดจากบริการ ความประมาท กิจกรรมที่ผิดกฎหมายหรือไม่มีใบอนุญาต ประกันที่ไม่เพียงพอ เนื้อหา หรือการฝ่าฝืนข้อกำหนดของผู้ให้บริการ ผู้ใช้ทุกคนรับผิดในลักษณะเดียวกันต่อการฉ้อโกง การกระทำผิดกฎหมาย เนื้อหา หรือการใช้แพลตฟอร์มโดยมิชอบโดยเจตนา ข้อนี้ไม่ใช้กับส่วนที่เกิดจากการกระทำผิดกฎหมายของ TripBidTravel และไม่จำกัดสิทธิที่กฎหมายห้ามสละ
15. การหยุดชะงักและเหตุสุดวิสัย
TripBidTravel ไม่รับผิดชอบต่อความล่าช้าหรือความล้มเหลวที่เกิดจากเหตุซึ่งอยู่นอกเหนือการควบคุมอย่างสมเหตุสมผล เช่น ภัยธรรมชาติ สภาพอากาศรุนแรง เหตุฉุกเฉิน การกระทำของรัฐ การขนส่งหยุดชะงัก ระบบอินเทอร์เน็ตหรือคลาวด์ล่ม การโจมตีทางไซเบอร์ หรือเครือข่ายชำระเงินขัดข้อง ทั้งนี้ไม่ตัดสิทธิคืนเงินหรือสิทธิผู้บริโภคที่กฎหมายห้ามยกเว้น
16. ภาษา
ฉบับภาษาอังกฤษและภาษาไทยมีเจตนาให้สื่อสารกฎเดียวกัน หากกฎหมายบังคับกำหนดให้ฉบับภาษาไทยมีผลเหนือกว่า ให้ใช้ฉบับภาษาไทย มิฉะนั้น หากยังมีความไม่สอดคล้องหลังการตีความอย่างสมเหตุสมผล ให้ใช้ฉบับภาษาอังกฤษ ผู้ใช้ควรติดต่อ TripBidTravel ก่อนยอมรับหากไม่เข้าใจฉบับใดฉบับหนึ่ง
17. ข้อกำหนดทั่วไป
หากข้อใดบังคับใช้ไม่ได้ ข้ออื่นยังมีผล การไม่บังคับใช้ไม่ถือเป็นการสละสิทธิ ผู้ใช้โอนบัญชีหรือสัญญาไม่ได้หากไม่มีความยินยอมเป็นลายลักษณ์อักษร TripBidTravel อาจโอนสัญญาเมื่อมีการจัดตั้งบริษัท ปรับโครงสร้าง จัดหาเงินทุน หรือขายกิจการ ภายใต้กฎหมายและการแจ้งที่กำหนด ข้อกำหนดนี้ นโยบายความเป็นส่วนตัว และเงื่อนไขเฉพาะการจองเป็นข้อตกลงทั้งหมด การแจ้งอิเล็กทรอนิกส์อาจส่งไปยังอีเมลบัญชีหรือแสดงในบริการ
18. การเปลี่ยนแปลง กฎที่ใช้บังคับ และการติดต่อ
